Dear All,

The Office of the United Nations High Commissioner for Human Rights has the honour to invite non-governmental organizations to attend a public consultation convened by the Special Rapporteur on adequate housing, Ms. Raquel Rolnik, on "Security of tenure: cornerstone of the right to adequate housing".

Background

The Human Rights Council, in its resolution 15/8, requested the Special Rapporteur on adequate housing to:
"Identify best practices as well as challenges and obstacles to the full realization of the right to adequate housing, and identify protection gaps in this regard;
Give particular emphasis to practical solutions with regard to the implementation of the rights relevant to the mandate;
Pay special attention to the needs of persons in vulnerable situations as well as those belonging to marginalized groups."

The Special Rapporteur believes that one of the key challenges to the full realization of the right to adequate housing is the lack of security of tenure, which leaves many individuals and groups, such as those living in informal settlements, in very vulnerable situations. The Special Rapporteur's previous reports to the Human Rights Council (HRC/16/42) and the General Assembly (A/66/270) on post-conflict and post-disaster settings - and reactions to the reports from Governments and other stakeholders - confirmed this assessment.

The Special Rapporteur will dedicate her forthcoming report to the Human Rights Council (to be presented at the Council's 22nd session) to the issue of security of tenure. In her report she will examine the concept of security of tenure under international human rights law, and map out existing forms and systems of tenure worldwide, as well as relevant policies and practices at local, national and international level that ensure or improve tenure security.

In order to benefit from diverse views and perspectives and inform her report, the Special Rapporteur will organize a public consultation on "Security of tenure: cornerstone of the right to adequate housing". The consultation will provide an opportunity for the Special Rapporteur to give a briefing on her work, and for States, intergovernmental organizations, national human rights institutions, non-governmental organizations and other interested stakeholders to contribute their views.

The consultation will take place in Palais des Nations, Geneva, Switzerland, Room XI, on Wednesday 24 October 2012, from 10:00 to 13:00. The consultation will be held in English, with simultaneous interpretation from and to French and Spanish based on interpreters' availability.

Le Bureau du Haut-commissaire des Nations Unies aux Droits de l'Homme a l'honneur d'inviter les organisations non-gouvernementales à une consultation publique sur « la sécurité légale de l'occupation: pierre angulaire du droit à un logement convenable », convoquée par la Rapporteuse Spéciale sur le logement convenable en tant qu'élément du droit à un niveau de vie suffisant ainsi que sur le droit à la non-discrimination à cet égard, Mme Raquel Rolnik.

Par sa résolution 15/8, le Conseil des Droits de l'Homme a prié la Rapporteuse Spéciale sur le logement convenable:
«D'identifier les meilleures pratiques ainsi que les difficultés et obstacles qui s'opposent au plein exercice du droit à un logement convenable, de même que les lacunes en matière de protection à cet égard;
De mettre l'accent en particulier sur des solutions concrètes pour assurer la mise en œuvre des droits qui relèvent de son mandat;
D'accorder une attention particulière aux besoins des personnes en situation de vulnérabilité ainsi que de celles qui appartiennent à des groupes marginalisés. »

La Rapporteuse Spéciale estime que l'un des principaux défis à la pleine réalisation du droit au logement est l'absence de sécurité légale de l'occupation (sécurité de la tenure), qui laisse de nombreuses personnes, notamment les habitants des quartiers informels, dans des situations de grande vulnérabilité. Les précédents rapports de la Rapporteuse Spéciale au Conseil des Droits de l'Homme (HRC/16/42) et à l'Assemblée Générale (A/66/270), concernant les situations après un conflit ou une catastrophe - et les réactions aux rapports des Gouvernements et autres parties prenantes - confirment ce point de vue.

La Rapporteuse Spéciale dédiera son prochain rapport au Conseil des Droits de l'Homme (qui sera présenté à la 22ème session du Conseil) à la question de la sécurité légale de l'occupation. Dans son rapport, elle examinera le concept de sécurité légale de l'occupation en vertu du droit international des droits de l'homme et documentera les diverses formes et systèmes de tenures existants à l'échelle mondiale, ainsi que les pratiques et politiques pertinentes au niveau local, national et international qui garantissent ou améliorent la sécurité légale de l'occupation.

Afin de bénéficier de divers points de vue et dans le but de rédiger son rapport,la Rapporteuse Spéciale organise une consultation publique sur « la sécurité légale de l'occupation: pierre angulaire du droit à un logement convenable ». La Rapporteuse Spéciale aura l'occasion de faire un exposé de son travail, et les États, les organisations intergouvernementales et non-gouvernementales, les institutions nationales des droits de l'homme et autres parties prenantes pourront s'exprimer sur ces questions.
